Terms and Conditions
Terms and Conditions (“Agreement”) govern the provision of telecommunications and broadband internet services (“Services”) provided by JCFiber (“Company”) to the consumer (“Consumer”). By subscribing to, accessing, or using the Services, Consumer agrees to the terms and conditions set forth in this Agreement.
- Term and Termination:This Agreement is entered into on a month-to-month basiscommencing on the day the Consumer is provided service from Company and shall continue until terminated by either party. Upon termination of Service for any reason, Consumer is required to return all equipment provided by Company, in good working order and undamaged, to our main office located at 750 International Dr., Franklin, IN 46131. If equipment is not returned or is not in good working order or is damaged, Consumer will be subject to a two-hundred-and fifty-dollar ($250) equipment fee that will be charged to all closed accounts. This fee will be removed once all equipment is returned in good condition.
- Aid to Construction Fee:Aid to construction fees may apply and aredisclosed during the sign-up process when selecting a service package and evaluated during the on-site engineering appointment. For Consumers residing in homes located more than 400 feet from the public road or Company’s nearest infrastructure capable of serving the premises:
- Overhead service: $1.50 per foot for each foot exceeding 400 feet
- Underground service: $3.00 per foot for each foot exceeding 400 feet
This fee is mandatory and will be invoiced prior to installation. Once construction has commenced on the Consumer’s premises, the aid to construction fee becomes non-refundable.
- Billing:
Bills will be generated by the Company on a recurring basis and are due 15 days from the invoice date unless otherwise stated in writing on the bill. Payment must be received in full by the due date indicated on the invoice.
Accounts not paid by the due date will be considered past due and may be subject to late fees.
Any account that remains unpaid beyond the due date may be scheduled for service disconnection. Services may be disconnected on or after the disconnect date specified on the bill if payment has not been received.
The Company reserves the right to pursue all lawful remedies to collect outstanding balances.
To promote efficient billing and payment processing, the Company requires enrollment in paperless billing and Automated Clearing House (ACH) payment processing.
- Paper Billing Fee: Accounts that elect to receive paper statements will be assessed a $5.00 monthly paper billing fee to cover printing and mailing costs.
- Non-ACH Processing Fee: Accounts not enrolled in ACH automatic payments will be assessed a $5.00 monthly administrative processing fee.
These fees will be applied separately and in addition to all other applicable charges. Accounts not enrolled in either paperless billing or ACH may incur both fees in the same billing cycle.
To establish a billing account, Consumer must provide a valid Social Security Number (SSN) and Date of Birth (DOB).
- Lawful Use and Indemnification:Consumerwarrants that all Services and equipment provided by Company will be used solely for lawful purposes and in compliance with all applicable federal, state, and local laws, regulations, and rules governing telecommunications. Consumer agrees to comply with Company’s Acceptable Use Policy, as amended from time to time. Company’s Acceptable Use Policy can be found on our website. Consumer agrees to indemnify, defend, and hold harmless Company from and against all direct consequences and punitive damages, including reasonable attorney fees, arising from Consumer’s unlawful use of the Services.
- Limitation of Liability:Company’stotal liability to Consumer for any claim arising out of or related to this Agreement or the provision of Services shall not exceed an amount equal to three (3) months of the Consumer’s monthly recurring service charges.
- Taxes and End User Charges:In addition to the fees set forthfor the Services provided by the Company, the Consumer is responsible for all applicable federal, state, and local taxes, end user charges, assessments, and user fees imposed in connection with the Services or equipment provided, including any such amounts assessed upon termination of this Agreement.
- Collections, Interest, and Recovery Costs:Consumeragrees that any unpaid balance shall accrue interest at the rate of 8% per year until paid in full. Company reserves the right to place any unpaid account with a collection agency. In the event an account is placed for collection, Consumer agrees to be responsible for:
- The unpaid balance;
- Collection fees equal to 33.33% of the unpaid balance placed for collection;
- Interest at the rate indicated in this Section; and
- Any other costs of collection permitted by law.
If an attorney is utilized by the collection agency or by Company to pursue collection of the account, Consumer further agrees to be responsible for all reasonable attorney fees, court costs, sheriff service fees, and any other process fees incurred in connection with the collection effort.
- Governing Law and Dispute Resolution:This Agreement shall be governed by and interpretedin accordance with the laws of the State of Indiana. The Parties agree to first attempt to resolve any dispute through mediation. If mediation is unsuccessful, the dispute shall be resolved by binding arbitration pursuant to the Supreme Court of Indiana Rules for Alternative Dispute Resolution.
- Amendments:Any amendment to this Agreement mustbe in writing and signed by authorized personnel of both parties. For purposes of this Agreement, “authorized personnel” on behalf of Company means any corporate officer of the Company.
- Acceptable Use Policy:By subscribing toCompany Services, Consumer agrees to abide by all applicable Acceptable Use Policies published on the websites of:
- JCFiber (jcfiber.com)
- Ninestar Connect, LLC (ninestarconnect.com)
These policies may be amended from time to time and are incorporated herein by reference.
The Company reserves the right to modify, amend, or update these Terms and Conditions at any time, in its sole discretion, as necessary to reflect changes in business practices, legal requirements, or service offerings.
Customers will be notified of material changes to the Terms and Conditions by reasonable means, which may include notice on the Company’s website, billing statements, email notification, or other written communication. Unless otherwise stated, updated Terms of Service will become effective as of the date specified in the notice.
By initiating service with Company, Consumer acknowledges they have read, understood, and agree to be bound by this Agreement.
